Terms of Service

You must be at least 18 and able to form a binding contract. Anyone can browse public pages without an account.

• You sign in with a one-time code sent to your mobile number or email. It’s the same TOLA account you use on TOLAHOUSE. Give us accurate information and keep your phone and email secure; you are responsible for activity on your account.
• Accounts are personal and may not be shared or transferred. Tell us right away about any unauthorized use.
• Your public builder profile (tola.school/@username) may be created from your existing TOLA profile. You can edit it any time.
• We may suspend or end accounts that break these Terms, commit fraud, or put others at risk.

TOLASCHOOL lets you create projects, post progress videos and images, comment, follow builders and projects, join Build Seasons, request to collaborate, and report content. Projects, videos, comments, community posts and profiles are public unless a feature says otherwise (for example, an unlisted or draft video). Think before you post.

Some example projects on the site are clearly marked “Sample.” They are fictional and shown to illustrate how TOLASCHOOL works.

• You keep ownership of what you post (videos, images, text and other material, your “Content”). You give us a non-exclusive, worldwide, royalty-free license to host, store, transcode, display, distribute and promote your Content as needed to run and improve the Services, including showing it on TOLASCHOOL and in previews when people share links. This license ends when you delete the Content, except for copies already shared by others or kept in backups for a limited time.
• You promise you have the rights to everything you post, including music, footage, images and the likeness of anyone who appears in your videos, and that your Content follows these Terms and our Community guidelines.
• Collaborators you invite can post episodes to and edit your project. You are responsible for who you invite.

When using the Services, you may not:

• Use the Services unlawfully or to harm, harass, threaten or deceive anyone
• Post content that is illegal, hateful, discriminatory, sexually explicit, violent, infringing or misleading
• Show or share instructions that put people at risk, or encourage dangerous activities without appropriate care
• Impersonate others, create fake accounts, or misrepresent your projects to collect money or personal information
• Spam, scrape, or abuse likes, follows, comments, reports or uploads
• Upload malware, or reverse engineer, overload or interfere with the Services
• Share your account or sign-in codes

Anyone can report a video, project, comment, post or profile. We may remove content, limit features or suspend accounts that break these rules, with or without notice. Creators can also remove comments on their own projects and videos.

We respect intellectual property. If you believe content on TOLASCHOOL infringes your copyright, email team@tola.house with: your contact details; the work you believe is infringed; the link to the material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act; and your physical or electronic signature. We may remove the material and, in appropriate cases, end the accounts of repeat infringers. If your content was removed and you believe it was a mistake, you can send us a counter-notice.

Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable right to use the Services. We and our licensors own the Services, including the software, design and the TOLA and TOLASCHOOL brands.

Links you add to projects and profiles, and services we rely on (such as video hosting), are provided by their own companies under their own terms. We are not responsible for them, their content or their availability. Builders are responsible for their own projects; we do not endorse or verify them.

The Services are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Content on TOLASCHOOL is created by builders, not by us, and is not professional advice. Building things can involve real risk (tools, electronics, money): use your judgment and follow safety practices.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, including from content posted by others, reliance on anything you see on TOLASCHOOL, loss of data, or unauthorized access to your account. Our total liability for any claim is limited to the greater of $100 or the amounts you paid us in the 12 months before the claim.

To the extent the law allows, you will defend and hold us harmless from claims by third parties arising from your Content, your use of the Services, or your breach of these Terms.

Please read this section carefully. It affects your legal rights.

• Informal resolution first. Before starting arbitration, you and we agree to try to resolve a dispute informally. Send a written notice describing the dispute and the relief sought (to team@tola.house, or from us to your account email or phone). If it isn’t resolved within 60 days, either party may start arbitration.
• Binding individual arbitration. Any dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator decides all issues, including whether a dispute must be arbitrated, except as stated below. Arbitration may be held by video or phone, or in Hillsborough County, Florida.
• Exceptions. Either party may bring an individual claim in small claims court, and either party may seek court relief to stop infringement or misuse of intellectual property.
• Class action waiver. You and we may bring claims only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding. If this waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration.
• Jury trial waiver. You and we give up the right to a jury trial.
• Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing team@tola.house with the subject line “Arbitration Opt-Out,” including your name and the phone number or email on your account. Opting out does not affect the rest of these Terms.
• Governing law and venue. These Terms are governed by the laws of the State of Florida and the Federal Arbitration Act, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be resolved in the state or federal courts located in Hillsborough County, Florida.

• We may update these Terms. We will tell you about material changes on the site or by email or text before they take effect. Using the Services after changes take effect means you accept them.
• Sections on content, disclaimers, limits of liability, indemnification and arbitration survive the end of your account.
• These Terms and the Privacy Policy are the entire agreement between you and us about TOLASCHOOL. If any part is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
